Program Description

Arctic Circle Restaurants, Inc. (“Arctic Circle,” “we,” “us,” “our”) offers an SMS-based authentication service for our mobile app and online ordering platform at acburger.com. By providing your mobile phone number and requesting a verification code, you are accepting these Terms & Conditions, and you consent to receive SMS messages from Arctic Circle for the purpose of account verification and authentication. To participate, you must have a text messaging enabled mobile device with a text messaging plan. Not all mobile devices may be supported and text messaging may not be available in all areas.

Types of Messages

You may receive the following types of SMS messages from us:

• One-time verification codes (OTP) for account login and authentication
• Account security alerts related to your login activity

These messages are transactional in nature and are sent only when you initiate a login or verification request. We do not send marketing, promotional, or advertising messages via SMS.

Message Frequency

Message frequency varies based on your usage. You will only receive an SMS when you request a verification code to log in. Typically, this is one message per login attempt.

Message and Data Rates

Message and data rates may apply. Please contact your wireless carrier for details about your messaging plan. Arctic Circle is not responsible for any charges imposed by your carrier.

Opt-Out

You can opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a confirmation message and will no longer receive SMS messages from Arctic Circle. Please note that opting out of SMS may prevent you from logging into your account via phone verification.

Supported Carriers

Our SMS service is supported on major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carriers are not liable for delayed or undelivered messages.

T-Mobile, AT&T, Verizon, Sprint, and other participating carriers are not liable for delayed or undelivered messages. Carriers and Arctic Circle are not responsible for any injury, loss, or damage arising from the use of mobile messaging.

Eligibility

Our SMS program is available to users in the United States. You must be the account holder or authorized user of the mobile phone number provided. You must be at least 13 years of age to use our services.

Privacy

By accepting these Terms & Conditions, you also agree to Arctic Circle’s Privacy Policy located at https://acburger.com/privacy-policy/.  Your phone number and related information are handled in accordance with our Privacy Policy. We do not sell, rent, or share your phone number with third parties for marketing purposes.

Changes to These Terms

We reserve the right to modify these SMS Terms & Conditions at any time. Changes will be effective upon posting to this page. Your continued use of the SMS service constitutes acceptance of the updated terms.
